The courtroom where Sean ‘Diddy‘ Combs’ eight-week bombshell trial took place was empty on Tuesday during a remote hearing on the sentencing scheduling.

The music mogul, 55, was acquitted of sex trafficking and racketeering last week, but convicted of two lesser prostitution offenses for which he faces up to 20 years in prison. 

But the cameras, supporters and journalists who filled the courtroom for weeks were gone as lawyers submitted a letter to the judge agreeing on an October 3rd sentencing date.

Diddy, his lawyers and prosecutors appeared remotely for the hearing Tuesday, which lasted only a few minutes. 

Prosecutors have asked for a sentence of about five years, while the defense is seeking 21 to 27 months.

Diddy remains jailed at a federal lockup in Brooklyn after his convictions on Wednesday. Any sentence will include credit for time already served. So far that’s almost 10 months.

Diddy likely to be sentenced on October 3rd

Diddy’s attorneys and prosecutors filed a joint request on Tuesday asking that the music mogul face sentencing on October 3rd.

Judge Subramanian later dismissed a scheduled hearing on the matter after a few minutes, saying he will respond to the sentencing request in writing.

Diddy and the lawyers were present in the hearing remotely.

Subramanian set an initial sentencing date of October 3rd last week but said he was open to expediting the hearing.

The defense first filed a letter asking that Diddy be sentenced on September 22, but they then agreed with the prosecution and the initial October date.

Diddy faces up to 10 years in prison for each prostitution conviction.

Diddy’s lawyers asked that he be released so he could take care of his mother

Diddy’s lawyer said in a letter asking for a $1million bond that his 85-year-old mother Janice is ill and he needs to take care of her in Miami.

‘Mr. Combs’s mother is 85 years old. She suffers from various health conditions. For example, she was hospitalized in July 2024 for a heart condition and had brain surgery the previous year,’ the defense letter said.

‘She lives near Mr. Combs in Florida and she would like him to be her primary caretaker.’

Diddy’s lawyers have asked Judge Arun Subramanian to allow Diddy to await sentencing for two counts of transportation to engage in prostitution in his mansion in Star Island.

Prosecutors have opposed the request, citing letters of concern by Cassie Ventura’s lawyer and witness Deonte Nash, who expressed fear of the mogul’s release.

Diddy trial featured weeks of harrowing testimony

Jurors deliberated for about 13 hours over three days before announcing their verdict. It came after they said late Tuesday that they had decided on four counts but were stuck on the racketeering charge.

At that point, the judge told them to keep deliberating and keep the partial verdict under wraps.

Diddy did not testify in the trial, which featured 34 witnesses as well as video of the rapper attacking his former girlfriend Cassie, the R&B singer born Casandra Ventura.

Cassie Ventura ‘at peace’ with verdict

Cassie Ventura is ‘at peace’ with the verdict, despite expecting Combs to be convicted on the sex trafficking count involving her.

In an interview with ABC News, Ventura’s attorney, Douglas Wigdor, said the sex trafficking charge was the ‘most important count to her.

‘I think that obviously she would be a lot happier if the jury had convicted on that,’ he said. ‘But she’s at peace with the verdict. She is moving ahead with her beautiful family and her husband.’

The attorney added that he will now speak to his client about giving a victim impact statement at Diddy’s sentencing.

‘I wouldn’t be surprised if she makes the decision to do that, because it’s important,’ Wigdor said.

Diddy lawyers declared verdict an ‘enormous victory and win’

Anna Estavao, one of the lawyers on Diddy’s defense team, on Wednesday declared the verdict an ‘enormous victory and win.’

‘This is a reminder to everyone I hope of the flaws in the criminal justice system and for everybody to take a second look when the government charges people with crimes,’ she told reporters outside of the Manhattan courthouse.

‘This is a huge win,’ she continued. ‘He was acquitted of sex trafficking, acquitted of RICO conspiracy and he will sleep well at night knowing that.’

Diddy lawyers slam new shocking Notorious B.I.G. claims

Diddy’s lawyers have slammed a new lawsuit claiming the music mogul doused a man with his semen after masturbating into a shirt that belonged to the late Notorious B.I.G.

The suit, filed on Monday by a John Doe, claims Diddy threw the shirt at the man after ejaculating into it during a listening session for a Biggie Smalls project.

One of the central pillars of the federal case were allegations that Combs sexually abused and coerced various women, with special focus on his long-term girlfriend Cassie Ventura and another woman only identified as Jane.

But criminal defense attorney David Gelman told the Daily Mail that both Ventura and Jane’s testimony were, in fact, devastating to the government’s case.

‘The prosecutors needed to show that they were all unwilling participants,’ Gelman explained, ‘I don’t see any force or coercion anywhere. People were paid but were doing this on their own free will.’

That prosecutorial failure ultimately saw jurors dismiss sex trafficking charges and only convict Combs on the two lesser counts of transportation to engage in prostitution, which each carry a maximum sentence of 10 years.

Prosecutors want violence factored into sentencing

Assistant U.S. Attorney Maurene Comey made it clear that prosecutors will argue that Diddy’s violent acts are part of the charges for which he was convicted and should factor into his punishment.

Diddy is ‘an extremely violent man with an extraordinarily dangerous temper,’ Comey told the judge Wednesday. He ‘has shown no remorse and no regret for his violence toward multiple victims.’

Subramanian noted that Diddy will be credited for the time he has already served.

But by rejecting bail, the judge indicated that he will likely reject a defense request for Diddy to be freed in the next year.

Diddy‘s ex-girlfriend who once accused the rapper of stomping on her stomach now claims she’s not worried about him being back on the streets because he never injured her.

‘He never did anything dangerous to me. I’m not scared,’ she said as she left a Vegas grocery store after TMZ asked if she feared for her life if Diddy was acquitted.

Her testimony was supposed to bolster the prosecution’s case against the Diddy and support the racketeering and sex-trafficking charges he was acquitted of.

But just before the trial started, prosecutors told the judge they were unable to get in touch with ‘Victim 3.’

OJ Simpson’s lawyer thinks Diddy will get long sentence

Robert Shapiro, the lead defense attorney in Simpson’s infamous murder trial, said Diddy would likely face two to three-and-a-half years in prison after being acquitted of sex-trafficking and racketeering but convicted for lesser prostitution offenses.

‘Having seen that this judge did not release him on bail, I think a message may be coming that you’re going to be spending a lot more time, so no reason to let you come out and come back in,’ Shapiro told Fox News Digital.

Shapiro noted that in denying Diddy bail, Judge Arun Subramanian mentioned the mogul’s ‘propensity for violence,’ citing the 2016 footage of the rapper assaulting Cassie Ventura in a hotel hallway in Los Angeles.

‘If the judge looks at that tape in his mind and is reminded about it again… I think there is a real chance that a substantial sentence will be forthcoming,’ the attorney said.

Shapiro’s comments come as Diddy, his lawyers, and prosecutors are expected to meet with Judge Subramanian for a post-trial hearing on Tuesday to discuss a sentencing schedule.

Despite a courtroom victory that saw Diddy cleared of the most serious charges of sex trafficking and racketeering, the atmosphere in the court grew tense again on Wednesday as the music mogul prepared to learn whether he’d finally be released on bail.

Eighty-year-old Janice, who had been surrounded by family members all day, stole a few minutes for herself alone in the courthouse bathroom – calmly fixing her lipstick in the mirror as the judge’s decision loomed.

Deonte Nash, a former stylist for Combs and Cassie who reluctantly testified during the trial, told the judge in a letter that bail would ‘send a dangerous message: that wealth and influence can shield someone indefinitely from accountability.’

Cassie, through her lawyer, also encouraged Subramanian to keep Combs in jail.

‘Ms. Ventura believes that Mr. Combs is likely to pose a danger to the victims who testified in this case, including herself, as well as to the community,’ Cassie’s lawyer, Douglas Wigdor, wrote.

Defense won jury over by admitting Diddy is a domestic abuser

The verdict in Manhattan federal court came after a veteran team of eight defense lawyers led by Marc Agnifilo executed a trial strategy that resonated with jurors.

Combs passed lawyers notes during effective cross-examinations of nearly three dozen witnesses over two months, including Diddy’s ex-employees.

The lawyers told jurors Combs was a jealous domestic abuser with a drug problem who participated in the swinger lifestyle through threesomes with his girlfriends and other men.

‘You may think to yourself, wow, he is a really bad boyfriend,’ Combs’ lawyer Teny Geragos told jurors in her May opening statement. But that, she said, ‘is simply not sex trafficking.’

Agnifilo said the blunt talk was a ‘no brainer.’

‘The violence was so clear and up front and we knew the government was going to try to confuse the jury into thinking it was part of a sex trafficking effort. So we had to tell the jury what it was so they wouldn’t think it was something it wasn’t,’ he said.

Diddy received standing ovation in jail after acquittals

Diddy got a standing ovation from fellow inmates when the music mogul returned to jail after winning acquittals on potential life-in-prison charges, providing what his lawyer says might have been the best thing he could do for incarcerated Black men in America.

‘They all said, “We never get to see anyone who beats the government,”‘ attorney Marc Agnifilo said a few days after a jury acquitted Combs of sex trafficking and racketeering conspiracy charges.

After federal agents raided Combs’ homes in Los Angeles and the Miami area in March 2024, Agnifilo said he told the “I’ll Be Missing You” singer to expect to be arrested on sex trafficking charges.

‘I said: “Maybe it’s your fate in life to be the guy who wins,”‘ he recalled during a telephone interview briefly interrupted by a jailhouse call from Combs. ‘They need to see that someone can win. I think he took that to heart.’

George also described the video evidence he saw of the ‘freak offs’ at the center of the case against Diddy, who in the end was only convicted of lesser prostitution offenses.

Former federal prosecutor Jennifer Beidel told DailyMail.com the judge’s comments suggest he will side with prosecutors, who want Diddy to face four to five years – above the guidelines based on the sentences of other similarly situated defendants.

Post-trial hearing to focus on sentencing schedule

Diddy will be appear in court remotely on Tuesday at 2pm EST for a post-trial hearing on the sentencing schedule.

The 55-year-old music mogul was acquitted last week of sex trafficking and racketeering charges but convicted on two counts of transporting individuals for prostitution.

His lawyers are pushing for less than the recommended 21 to 27 months behind bars, while prosecutors argue his crimes — and history of violence — justify at least four to five years.

The judge has tentatively scheduled sentencing for October but said he’s open to moving it up, with further discussion expected at today’s hearing.

U.S. District Judge Arun Subramanian will decide Diddy’s sentence and isn’t required to follow the usual federal guidelines, meaning he has plenty of leeway.

Diddy’s lead defense attorney Marc Agnifilo previously urged the judge to release the mogul on a $1 million bond, insisting his client had changed dramatically over the past year.

But Subramanian was unmoved and denied him bail, citing his ‘propensity for violence’ against his ex-girlfiends and accusers Cassie Ventura and ‘Jane.’

The maximum possible sentence for each of the prostitution convictions is 10 years in prison.

Diddy has already spent 10 months in jail since his September arrest.
